Welcome to Mr Tube, a service provided by North Web. These Terms of Service (“Terms”) govern your access to and use of the Mr Tube website located at MrTube.org (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Service.

1. Acceptance of Terms

By accessing or using the Service, you represent that you are at least 13 years old or of the age of majority in your jurisdiction and possess the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you affirm that you have the authority to bind that organization to these Terms.

3. Account Registration

1. Account Creation:

To access certain features of the Service, you must create an account. When creating an account, you agree to provide accurate, current, and complete information, including your email address and any other information required during registration. You are responsible for keeping this information updated.

2. Account Security:

You are solely responsible for maintaining the confidentiality of your account login information, including your password. You agree to notify Mr Tube immediately of any unauthorized use of your account or any other breach of security. Mr Tube will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Account Verification:

Mr Tube reserves the right to verify your identity and age before granting access to certain features of the Service. This may involve requesting identification or other documents.

Mr Tube (North Web), can hold payments from user if any of the following

1. No User identification presented as a Worker Individual, Company or other legal term in their territory country.
   
   
2. No documentation comproving the payment from Mr Tube (North Web)
   
   
3. Other situation as a account blocked, ilegal content or similar.

 

4. Service Description

Mr Tube is a free to use platform that enables content creators (“Creators”) to share content with their Fans (Subscribers). Creators can set subscription prices and earn revenue through donations, paid and rented videos, and other interactions. The Service may include features such as:

1. Content Sharing: Creators can upload photos, videos, and other types of content for their subscribers.

2. Communication Tools: Fans may send messages, comments, or donations to Creators.

5. Content Guidelines

1. User Content:

All content uploaded, shared, or otherwise made available by Creators is their sole responsibility. Mr Tube (North Web), does not endorse any user-generated content and is not liable for its accuracy, legality, or appropriateness.

2. Prohibited Content:

Users are prohibited from uploading or sharing any content that:

1. Is illegal or promotes illegal activities.

2. Contains nudity or sexually explicit material that violates community guidelines.

3. Is abusive, defamatory, threatening, or harassing.

4. Violates the rights of any third party, including intellectual property rights.

5. Contains viruses, malware, or other harmful software.

Mr Tube reserves the right to review and remove any content that violates these guidelines, at its sole discretion.

6. Payment and Fees

1. Subscription Fees:

Fans must pay the subscription fee set by the Creator to access their content. Fees may vary and are subject to change. Any changes to subscription fees will be communicated to Fans prior to the change taking effect.

2. Revenue Share:

Mr Tube retains a percentage of the subscription fees and tips as a commission. The specific commission rate will be disclosed on the Service. Creators will receive payments according to a predetermined schedule, subject to the payment processor’s terms.

3. Payment Processing:

Payments are processed through a third-party payment processor (e.g., Stripe, PayPal). By using the Service, you agree to comply with the payment processor’s terms of service. Mr Tube is not responsible for any issues arising from payment processing, including but not limited to delays or transaction failures.

4. Refunds:

All payments are non-refundable unless otherwise stated. If a Creator is found to be in violation of these Terms, Subscribers may report the issue to Mr Tube, which may lead to a refund at Mr Tube' discretion.

7. User Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe on the rights of others. You must not engage in any of the following prohibited activities:

1. Harassment or abuse of other users, including hate speech or threatening behavior.

2. Impersonation of any person or entity, including Mr Tube representatives.

3. Attempting to gain unauthorized access to the Service, accounts, or computer systems connected to the Service.

4. Disrupting the operation of the Service or engaging in any form of automated data collection (e.g., bots, scrapers).

8. Intellectual Property

1. Ownership:

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Mr Tube and its licensors. These materials are protected by copyright, trademark, and other intellectual property laws.

2. User License:

Subject to these Terms, Mr Tube grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any resale or commercial use of the Service or its contents.

3. Creator Content:

Creators retain ownership of the content they upload. By sharing content on the Service, Creators grant Mr Tube a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute their content for the purpose of operating and promoting the Service.

9. Termination

1. Termination by You:

You may terminate your account at any time by following the instructions in your account settings. Upon termination, you will no longer have access to the Service, and your data may be deleted as per our data retention policies.

2. Termination by Mr Tube:

Mr Tube reserves the right to suspend or terminate your account and access to the Service at its discretion, without prior notice, for any violation of these Terms or any conduct that Mr Tube deems inappropriate or harmful.

10. Disclaimers

The Service is provided “as is” without warranties of any kind, either express or implied. Mr Tube disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mr Tube does not guarantee the accuracy, reliability, or availability of the Service.

11. Limitation of Liability

To the fullest extent permitted by law, Mr Tube and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of profits, data, or use, even if Mr Tube has been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mr Tube, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorney fees) arising out of or related to:

1. Your use of the Service.

2. Your violation of these Terms.

3. Your violation of any rights of another party, including intellectual property rights.

4. Any content you upload or share on the Service.

13. Compliance with Laws

As a Software as a Service (SaaS) provider, Mr Tube complies with all applicable laws and regulations worldwide. Users are responsible for ensuring that their use of the Service complies with the laws of their respective jurisdictions.

14. Changes to Terms

Mr Tube reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Service. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If the changes are material, Mr Tube will provide notice by email or through a notification on the Service.

15. Governing Law

These Terms are governed by international law principles. Where international law is not enforceable, the laws of Belgium will apply. Any disputes will be resolved through arbitration as outlined below, unless otherwise required by local law.

16. Dispute Resolution

1. Informal Resolution:

Before initiating any formal legal action, you agree to attempt to resolve any disputes informally by contacting Mr Tube through the contact information provided below.

2. Arbitration:

If a dispute cannot be resolved informally, you and Mr Tube agree to binding arbitration under the rules of the Belgian Centre for Arbitration and Mediation (CEPANI), conducted in Belgium and in English. You waive any right to participate in class action lawsuits or class-wide arbitration.

17. General Provisions

1. Severability:

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

2. Waiver:

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term or condition, and any failure by Mr Tube to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

3. Assignment:

You may not assign or transfer these Terms or any rights or obligations hereunder without Mr Tube prior written consent. Mr Tube may assign or transfer these Terms at any time without notice.
